Wheaton defense attorney Don Ramsell, was recently mentioned in a Daily Herald article concerning mug shots online, including paying for the service to view and remove the jail photographs from the Internet.
According to the Daily Herald, Ramsell supports a bill for free speech rights for mug shot website operators, but the bill does not allow the opportunity to capitalize from Internet users. The Daily Herald reports, “I don’t see this as a complete answer, but it’s a good start,” he said. “An extortionist would go out of business if he wasn’t allowed to receive money.”
The proposed bill would ban mug shots from websites that carry arrest records. It would also prevent the websites from monetizing on services to remove the mug shots. Legislators believe this will help middle class workers find more jobs and believe the profit of these websites is an exploitation of freedom of speech.
According to the Daily Herald, “The proposal received unanimous support from both houses in May and would put legal enforcement under the purview of the Illinois attorney general’s office. Websites and other media outlets that solicit or accept money to remove criminal arrest information could be dissolved, suspended or face fines up to $50,000, among other civil sanctions.”
